THE LEGAL FACTS
ILLEGAL
* A handheld mobile phone used in a motor vehicle whilst the engine is running is - ILLEGAL.
* A handheld mobile phone used in a motor vehicle whilst parked on the kerbside with the engine running is - ILLEGAL.
* A handheld mobile phone used in a motor vehicle whilst stopped at traffic lights is - ILLEGAL
* A handheld mobile phone used in a motor vehicle whilst in a traffic jam with engine running or not, is ILLEGAL
A Police Officer will, as always, use his discretion in such circumstances.
LEGAL
* A handheld mobile phone used in a motor vehicle parked on the kerbside with the engine switched OFF is - LEGAL.
* Handsfree mobile phones used in motor vehicles are LEGAL provided the handset is situated in a fixed 'cradle' - however if a Police Officer deems that a vehicle is being driven erractically or without due care as a result of using a hands free mobile phone a prosecution may ensue.
THE USE OF TWO-WAY RADIO EQUIPMENT IN MOTOR VEHICLES SUCH AS CB SYSTEMS COMES UNDER THE SAME LEGISLATION
